General Australian consumer preparation information. Not advice about an individual matter. Examples are illustrative. Read source scopes before applying jurisdiction-specific information.

> One collision can raise several different legal questions. Identify each issue before assuming one insurer or one engagement deals with everything.

After immediate safety and medical needs have been addressed, a collision may leave you dealing with repairs, injury, an insurer and a notice from police. Those are not interchangeable tasks. Legal Aid NSW’s car accident resources distinguish different parts of the problem. Use this guide to prepare for advice in the relevant jurisdiction, not to determine fault, calculate damages or decide what must be reported.

## Separate property damage, injury and traffic issues

Use separate headings for vehicle or property damage, personal injury, insurance correspondence and any traffic allegation. Record who has contacted you under each heading and what response is requested. A person assessing damage to a vehicle may not be advising on injury compensation or a criminal charge. Ask the law firm which parts it can consider and whether separate referrals or engagements are needed.

- Property: repair quote, assessment, demand or invoice.
- Injury: treating-provider details and claim correspondence.
- Traffic: the complete notice or charge document.

## Preserve the accident record

Keep original photographs, footage, correspondence, incident references and the contact details you lawfully obtained. Write a dated account of what you remember and identify anything learned from someone else. Do not modify footage or discard inconvenient parts of a conversation. If material is held by another person or business, tell the lawyer what it is and ask how to approach preservation or access. Avoid promising that particular evidence proves responsibility.

## Organise insurance communications

Identify the insurer, policy and claim reference for each relevant policy, along with any decision or request received. Separate a claim acknowledgement from a decision about cover or liability. Keep copies of settlement offers and documents you are asked to sign. Ask the adviser what issues it will assess before responding; a directory guide cannot determine the effect of a release or an admission in your circumstances.

## Show dates and interstate connections early

Tell the office where the accident occurred, where the vehicle was registered and whether employment or another state is involved. Bring the date of the accident and the dates notices were received. Injury schemes, insurance processes and court proceedings can have different requirements. Ask for the relevant timing to be checked promptly. Do not assume that an open insurance claim covers every potential action or pauses another process.

## Compare the scope of accident-related legal help

Ask whether the first appointment covers liability advice, an insurer decision, a demand, an injury claim or representation on a traffic matter. Request the proposed output and cost basis for that task. If someone else is already advising you, explain their role and accepted work. Separate the legal fee from medical reports, repair assessments, filing expenses and any other external item whose necessity and cost require confirmation.

## Make the next action specific

Illustrative example: your vehicle is repaired, an insurer has rejected part of the claim and you have received a separate traffic notice. A useful enquiry names all three developments and asks the office to identify which it can handle first. After the meeting, record who will contact the insurer, who is reviewing the notice and what remains outside scope. Avoid treating one helpful conversation as acceptance of every consequence of the collision.

## Will a vehicle damage lawyer also handle an injury claim?

Do not assume so. Describe both issues and confirm the named practitioner’s accepted scope, costs and any referral needed.

## Can I use a guide from another state?

It can help you organise questions, but the accident location, scheme and documents need individual assessment. NSW resources do not establish nationwide procedures.
